Danish developer Interceptor Entertainment, the team behind the 2013 Rise of the Triad reboot, has acquired original Duke Nukem creators Apogee Software, Ltd/3D Realms, reports Denmark’s Børsen.
Interceptor CEO Frederik Schreiber confirmed the news on Twitter, adding the developer will be releasing an official statement tomorrow.
“With this acquisition, we aim to strengthen 3D Realms and protect the legend that it is,” said Mike Nielsen, who has been identified by Børsen as the newly appointed CEO of Apogee Software and 3D Realms.

Interceptor and Apogee Software, Ltd. (which is the formal name of 3D Realms) are currently entwined in legal action with Gearbox Software, which has filed a federal lawsuit against both of them for copyright infringement. In the filing Gearbox alleges 3D Realms and Interceptor are seeking to “misappropriate and make infringing use of the Duke Nukem trademarks and copyrights owned by Gearbox.” At the time of the filing 3D Realms and Interceptor appeared set to announce a new Duke Nukem game, Duke Nukem: Mass Destruction. Gearbox has asserted the development is unsanctioned and breaches Gearbox’s intellectual property rights. Gearbox secured the rights to the Duke Nukem property on February 2, 2010. The agreement required 3D Realms or its licensees to seek Gearbox’s permission before making use of Duke Nukem after that date.
Headquartered in Aalborg, Denmark, Interceptor Entertainment was founded in 2010. Today it employs staff across 10 countries who work remotely. Apogee Software was founded way back in 1987 but began to publish all its games under the 3D Realms brand during the mid-’90s.
In 2008 the Apogee name, logo, and library were licensed to a separate company known as Apogee Software, LLC. Interceptor worked with the company on Rise of the Triad, although Apogee Software, LLC co-founder Terry Nagy has told Polygon “Interceptor Entertainment has not acquired Apogee Software, LLC nor any of our IP including Rise of the Triad.”
